Terms of Sales

The general conditions of sale are concluded between on the one hand PHYTO 5 (hereinafter referred to as PHYTO 5), operated by Laboratoire Gibro / Entre-deux Rivières 10 / CH-2114 Fleurier / Switzerland (registered with the commercial register of the Canton of Neuchâtel), and on the other hand any person making a purchase from the website www.PHYTO5.com (hereinafter referred to as the “Customer”).

The www.PHYTO5.com offer is limited to the territory of Switzerland.

1. Scope of application

The general conditions of sale apply to all legal acts carried out on the site www.PHYTO5.com .

PHYTO 5 reserves the right to modify the general conditions of sale at any time, without notice. Therefore, the applicable conditions are those in force on the date of the Customer's order.

2. Products

The products are those listed on the site www.PHYTO5.com , while stocks last. PHYTO 5 reserves the right to modify the assortment at any time. Each product is presented with the necessary information which allows the Customer to know, before placing the final order, the essential characteristics of the product he wishes to purchase. The images appearing on the website are not contractual.

3. Price

All prices indicated are in Swiss francs (CHF), all taxes included (TTC). PHYTO 5 reserves the right to modify prices at any time and without notice. The prices applied to the Customer are those indicated on the site on the day of the order. Any change in the VAT rate may be reflected in the price of the products. Payment of the entire price must be made when ordering, and in any case before shipping the items ordered. At no time can the sums paid be considered as deposits or deposits.

4. Order

PHYTO 5 only accepts orders from Customers residing in Switzerland. The contract is concluded when the Customer's order is validated by PHYTO 5. PHYTO 5 reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order.

5. Payment

The payment methods available on the site are as follows:

  • Master Card
  • Visa
  • Twint
  • Postfinance and e-finance

PHYTO 5 reserves the right to suspend all order management and delivery in the event of refusal of authorization for payment by credit card from officially accredited organizations or in the event of non-payment of the order.

Payments on the site are secure via the Stripe platform.

6. Delivery

Delivery can only be made in Switzerland.

Delivery costs are offered to the Customer, with no minimum order. Delivery is made by Swiss Post. Orders placed and validated before 2 p.m. are delivered within 1 to 2 working days (weekends and public holidays are excluded from working days). The delivery times indicated in these conditions of sale are given for information purposes only.

7. Return conditions

The Customer has the right to return the product(s) that he/she does not wish to keep within 7 days of receipt of the order.

Returns are only accepted if the original packaging is intact.

Compliant returns are subject to a refund, made within 14 days after receipt and verification of the product.

Returns must be announced to PHYTO 5 by email to team@phyto5.com and include: the order number, the designation of the item to be refunded and the reason for return. Without these instructions, the return cannot be made.

8. Copyright

All texts, documents, images, videos present on the PHYTO 5 site are subject to copyright. It is strictly forbidden to use them without the formal written consent of PHYTO 5.

9. Data protection

The information requested from the Customer is necessary for the processing of his order and may be communicated exclusively to the contractual partners of PHYTO 5 involved in the execution of this order. The Customer can write to PHYTO 5 (team@phyto5.com) to exercise his rights of access and rectification with regard to the information concerning him and appearing in the PHYTO 5 files.

10. Applicable law and competent jurisdiction

The contract is subject exclusively to Swiss law of obligations and other rules promulgated by Swiss legislation.

The competent court for any dispute with PHYTO 5 is the court of Neuchâtel.
